I-937 Qualification

Initiative 937 qualification requires "(a) Electricity from a generation facility powered by a renewable resource other than fresh water that commences operation after March 31, 1999,"

The commisioners argue that as they are "restarting" the facility can be deemed to commence operation after March 31, 1999. Since the Generation assets are of 1957 Vintage and the PUD's investment is catch-up maintenance and certification this is quite a stretch.

The commisioners claim that they have official approval in the form of a letter from the department of Community, Trade and Economic Development (CTED), but in fact they have nothing, as the letter from CTED states, the State Auditor is responsible for implementing I.937, not CTED. As Ms. Wilkerson makes clear "Anything stated in this letter must be construed as analytic in nature and not as judgemental regarding compliance with I-937
